1. Agreement to Terms

These Terms of Service ("Terms") constitute a legally binding agreement between you and Astro Ventures LLC d/b/a SwoopClean ("SwoopClean," "we," "us," or "our"). By accessing or using SwoopClean's website, mobile applications, or services, you agree to be bound by these Terms. If you do not agree, please do not use our services.

We may update these Terms from time to time. We will notify you of material changes by posting the updated Terms on our website and updating the "Last updated" date. Your continued use of our services after changes are posted constitutes acceptance of the revised Terms.

2. Services

SwoopClean is a cleaning service marketplace that connects customers with independent cleaning professionals. Our services include standard cleaning, deep cleaning, move-in/move-out cleaning, and short-term rental turnover cleaning.

Quotes provided through our platform are estimates based on the information you provide, including photos analyzed by AI technology. Final pricing may vary based on actual conditions encountered during service.

3. Booking and Cancellation

Bookings are confirmed upon payment authorization. We reserve the right to cancel or reschedule services due to unforeseen circumstances, in which case you will receive a full refund.

Cancellation Policy:

  • Cancellations made 48 or more hours before the scheduled service: full refund.
  • Cancellations made 24-48 hours before: 50% of the quoted price may be charged.
  • Cancellations made less than 24 hours before: up to 100% of the quoted price may be charged.

4. SMS Communications (SwoopClean Notifications)

By providing your mobile phone number and checking the SMS consent box during booking or account creation, you expressly consent to receive transactional and informational text messages from the SwoopClean Notifications program. These messages may include:

  • Booking confirmations and reminders
  • Cleaner arrival and en-route notifications
  • Service updates, changes, and completion notices
  • Responses to your text inquiries

Message Frequency: You will receive approximately 3-8 messages per booking, depending on the service type and any schedule changes. Overall frequency varies based on your booking activity.

Msg & data rates may apply. Message and data rates from your wireless carrier may apply to messages you send and receive. SwoopClean is not responsible for any charges from your mobile carrier. Check your plan for details.

Consent is not a condition of purchase. You are not required to consent to receiving SMS messages as a condition of purchasing any services from SwoopClean. You may complete bookings without opting in to SMS notifications.

Opt-Out: You may opt out of SMS notifications at any time by texting STOP to any message from SwoopClean. You will receive one final confirmation message, and no further messages will be sent unless you opt back in. You may also opt out by updating your notification preferences in your account settings or by contacting us at admin@swoopclean.com.

SMS Service Provider: We use Twilio as our SMS service provider to deliver messages on our behalf. Your mobile phone number and opt-in status are shared with Twilio solely for the purpose of delivering these notifications.

Carrier Liability: Wireless carriers are not liable for delayed or undelivered messages. Delivery is subject to effective transmission from your network and is outside our control.

Privacy: Your mobile number is collected solely for delivering service notifications. We will not sell, rent, or share your mobile number or SMS opt-in consent with third parties for their marketing or promotional purposes. See our Privacy Policy for full details.

5. Payment

Payment is authorized at the time of booking and captured upon completion of service. We accept major credit cards and debit cards through our secure payment processor, Stripe. All payment information is processed directly by Stripe and is never stored on our servers.

6. Property Access

You are responsible for providing safe and reasonable access to your property. Our cleaning professionals must have access to running water and electricity to perform services. You agree to secure or disclose valuables and fragile items prior to service.

7. Photo Upload and AI Analysis

Our platform allows you to upload photos of your property to receive more accurate cleaning quotes. By uploading photos, you acknowledge and agree that:

  • Photos are processed by Google Gemini AI to assess cleaning requirements and generate accurate estimates.
  • Photos are stored securely and automatically deleted after 90 days.
  • Photos are used solely for the purpose of providing and improving our cleaning services.
  • You may request deletion of your photos at any time by contacting privacy@swoopclean.com.

8. Liability and Insurance

SwoopClean carries general liability insurance covering property damage caused by our cleaning professionals during service. Claims for property damage must be reported within 48 hours of service completion.

Property Damage Cap: Our maximum liability for property damage claims arising from a single service visit is $5,000 per occurrence.

We are not liable for pre-existing damage, normal wear and tear, or items of extraordinary value (exceeding $1,000) that were not disclosed prior to service.

Nothing in these Terms excludes or limits our liability for personal injury caused by our negligence or the negligence of our cleaning professionals. California Civil Code Section 1668 prohibits contractual waivers of liability for personal injury caused by negligence, fraud, or willful misconduct, and we do not seek to limit such liability.

To the maximum extent permitted by applicable law, SwoopClean shall not be liable for indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, or business opportunities, regardless of the cause of action.

9. Independent Contractors

Cleaning professionals who provide services through the SwoopClean platform are independent contractors. SwoopClean is not responsible for the employment status, tax obligations, or benefits of these professionals. Each cleaning professional is responsible for maintaining their own insurance coverage.

10. Satisfaction Guarantee

If you are not satisfied with our service, please contact us within 24 hours. We will work with you to address any concerns, which may include a re-clean or partial refund at our discretion.

11. Dispute Resolution

These Terms are governed by and construed in accordance with the laws of the State of California. Any disputes arising from or relating to these Terms or our services shall be resolved in the state or federal courts located in Alameda County, California.

Before initiating any legal proceeding, you agree to first attempt to resolve the dispute informally by contacting us at legal@swoopclean.com. We will attempt to resolve the dispute within 30 days of receiving your notice.
